Terms of Use

Article 1: Purpose

These Terms of Use (the “Terms”) set out the conditions for accessing and using the website trybamora.com (the “Site”), published by Bamora.

They apply to every visitor to the Site, whether or not they make a purchase.

The conditions applicable to sales are set out separately in our Terms and Conditions of Sale. In the event of a conflict between the two documents on a matter relating to sales, the Terms and Conditions of Sale prevail.

Article 3: Acceptance

Access to the Site constitutes acceptance of these Terms. Users who do not accept them are asked not to use the Site.

Bamora may modify the Terms at any time. The applicable version is the one online at the time of consultation. The date of the last update appears at the top of the page.

Article 4: Access to the Site

The Site is accessible free of charge, 24 hours a day, 7 days a week, except for interruptions due to maintenance, updates or force majeure.

Bamora does not guarantee uninterrupted availability and cannot be held liable for temporary unavailability, whatever the cause. Internet access and equipment costs remain the responsibility of the user.

Article 5: Customer account

5.1 Creation

Creating an account is not required to place an order. When an account is created, the user undertakes to provide accurate information and to keep it up to date.

5.2 Login credentials

The user is solely responsible for the confidentiality of their login credentials and for any activity carried out from their account. In the event of unauthorized use, the user must inform Bamora without delay at contact@trybamora.com.

5.3 Deletion

The user may request deletion of their account at any time at contact@trybamora.com. Certain data is nevertheless retained to meet our legal obligations, in particular accounting obligations, under the conditions described in the Privacy Policy.

Article 6: Use of the Site

6.1 Permitted use

The Site is intended for personal, non-commercial use.

6.2 Prohibited conduct

In particular, it is prohibited to:

• disrupt the operation of the Site or attempt to access it in an unauthorized manner;
• systematically extract, reproduce or reuse all or part of the Site’s content, including by automated means (scraping);
• use the Site for fraudulent purposes, in particular using misappropriated payment methods;
• post content that is insulting, defamatory, discriminatory, or that infringes the rights of a third party;
• impersonate a third party.

In the event of a breach, Bamora reserves the right to suspend or remove access to the Site and the account concerned, without notice, without prejudice to any legal action.

Article 7: User-generated content

7.1 Reviews and comments

Where the Site allows reviews to be posted, the user warrants that their content is truthful, personal and free of any unlawful element.

7.2 Moderation

Bamora reserves the right to refuse or remove any content that violates these Terms, the law, or that is clearly unrelated to the product concerned.

No review is altered in its meaning, nor deleted solely because it is negative. The methods for collecting, moderating and publishing reviews are made known to users in accordance with Article L.111-7-2 of the French Consumer Code.

7.3 Rights granted

By posting content on the Site, the user grants Bamora a free, non-exclusive license to use that content for display on the Site and, where applicable, on our communication materials, for the duration of its publication.

Article 8: Intellectual property

All elements of the Site, including the Bamora brand, texts, photographs, illustrations, logos, graphic identity, structure and source code, are protected by intellectual property law and remain the exclusive property of Bamora or its partners.

Any reproduction, representation, adaptation or use, in whole or in part, without prior written authorization is prohibited and may constitute infringement.

Access to the Site confers no rights over these elements.

Article 9: Hyperlinks

The Site may contain links to third-party sites. Bamora has no control over these sites and disclaims all responsibility for their content or their personal data practices.

Linking to the Site is free, provided that it does not harm Bamora’s image and does not create any confusion as to the origin of the content.

Article 10: Published information

The information on the Site is provided for guidance only and may be updated at any time.

Editorial content relating to comfort, support or well-being is strictly informational. It does not constitute medical advice, a diagnosis or a treatment recommendation, and does not replace consultation with a healthcare professional.

Article 11: Personal data and cookies

Personal data processing is described in the Privacy Policy. The use of cookies and trackers is described in the Cookie Policy.

Article 12: Liability

Bamora uses reasonable means to ensure the accuracy of the information published and the security of the Site.

Its liability cannot be engaged for damage resulting from use of the Site that does not comply with these Terms, from temporary unavailability, or from an unforeseeable and unavoidable act of a third party.

Nothing in these Terms limits the rights that consumers hold under the mandatory provisions of the Consumer Code, in particular under the statutory guarantees.

Article 13: Partial invalidity

If any clause of these Terms is declared invalid, the remaining provisions continue to apply.

Article 14: Governing law and disputes

These Terms are governed by French law.

Consumers may use, free of charge, the consumer mediator designated in Article 12 of our Terms and Conditions of Sale.

Failing an amicable resolution, the French courts have jurisdiction. Consumers may bring proceedings, at their choice, before the court of the place where they lived at the time the contract was concluded or when the harmful event occurred.
